Platform: The CoHomez listing, matching, and management platform (the "Platform")
By accessing or using the Platform, you acknowledge that you have read, understand, and agree to be bound by all terms below.
1. Platform Purpose
- CoHomez is an online listing platform allowing property owners/managers ("Operators") to list intentional co-living spaces and connect with potential renters/members ("Applicants").
- We do not own or operate any properties and are not a broker, agent, property manager, or legal advisor.
- All leasing or membership agreements are made solely between Operators and Applicants.
2. Subscription Plans, Fees and Payments
Subscription Plans:
- Free Plan ($0/month): Includes 1 home, 0 assigned roles, 1 application form (up to 10 sections per form), 15 monthly credits, and full access to resident management, bed assignment, calendar management, resident community, and integrated billing & Autopay. Inquiry contact unlocks cost $5 each. CoHomez platform transaction fee on online rent payments: 2%. Add-ons: $35/month per additional home (+25 credits), $20/month per assigned role (+5 credits), $15/month for Unlimited Forms & Sections (+15 credits), $30/month for the Operations Suite (+50 credits).
- Landlord Plan ($40/month): Includes 2 homes, 0 assigned roles, unlimited application forms and sections, 150 monthly credits, full inquiry contact access at no per-unlock charge, and all Free plan features. 14-day free trial. CoHomez platform transaction fee on online rent payments: 0.5%. Add-ons: $20/month per additional home (+40 credits), $10/month per assigned role (+10 credits), $15/month for the Operations Suite (+75 credits).
- Community Pro Plan ($149/month): Includes 7 homes, 5 assigned roles, unlimited application forms and sections, 500 monthly credits, full inquiry contact access, the Operations Suite included at no extra charge, priority support, and all Landlord plan features. 14-day free trial. CoHomez platform transaction fee on online rent payments: 0.25%. Add-ons: $15/month per additional home (+75 credits), $5/month per assigned role (+15 credits).
Payment Terms:
- All subscriptions are billed monthly on a recurring basis.
- Free trials (14 days) apply only to paid plans (Landlord and Community Pro), not to add-ons.
- Credit card required to start trial. If trial is not canceled before expiration, subscription automatically converts to paid plan.
- Add-ons are billed immediately upon purchase and added to the monthly recurring subscription total.
- All fees are non-refundable, except as required by law.
- Subscriptions may be canceled anytime. Cancellation stops future billing, but users retain access until the end of the current billing period.
- No prorated refunds are provided upon cancellation.
- Fee avoidance (offline contact to bypass payment or platform usage limits) is strictly prohibited.
- CoHomez reserves the right to modify subscription plans, pricing, features, and limits at any time with notice to active subscribers.
Usage Limits and Enforcement:
- Each plan includes specific limits on homes, assigned roles, application forms, sections per form, and monthly credits. See Section 2a (Credit System & Usage) for credit allowances and per-action costs.
- Users who reach or exceed plan limits will be prompted to purchase add-ons or upgrade their plan to continue using restricted features.
- Credit-consuming actions are suspended when your monthly credit balance reaches zero, until credits refresh at the next billing period or an add-on granting additional credits is purchased.
- CoHomez may restrict or disable access to features if payment is overdue or plan limits are exceeded without upgrading.
- Usage tracking and monthly credit balances reset at the beginning of each billing period.
Online Rent Payment & Transaction Fees:
- Operators may enable online rent collection through the Platform via Stripe, a third-party payment processor. Stripe Connect is used to route payments to Operators' connected bank accounts.
- Stripe Processing Fees (assessed by Stripe): ACH Bank Transfer — 0.8% of the transaction amount, capped at $5.00 per transaction. Credit / Debit Card — 2.9% + $0.30 per transaction. These fees are assessed by Stripe directly.
- CoHomez Platform Transaction Fee (assessed per plan and retained by CoHomez): In addition to Stripe's processing fees, CoHomez charges a platform transaction fee on each online rent payment based on the Operator's active subscription plan:
- Free Plan: 2% of the transaction amount
- Landlord Plan: 0.5% of the transaction amount
- Community Pro Plan: 0.25% of the transaction amount
- The CoHomez platform transaction fee is retained by CoHomez; the remainder of each rent payment is routed directly to the Operator's connected Stripe Connect account.
- Unless otherwise agreed between the Operator and Resident, Stripe processing fees and the CoHomez platform transaction fee are the responsibility of the paying Resident.
- Operators are responsible for completing Stripe's identity verification and onboarding requirements before online payments can be enabled.
- CoHomez is not liable for any payment failures, delays, disputes, chargebacks, or errors arising from the use of Stripe or any other third-party payment processor.
- Residents and Operators are encouraged to retain records of all online transactions for their own records.
- Agreement to Stripe Terms: By using CoHomez to purchase subscriptions, add-ons, or process any payments, you acknowledge and agree that payment processing services are provided by Stripe, Inc. ("Stripe"). You agree to be bound by the Stripe Connected Account Agreement and the Stripe Services Agreement, as applicable, which may be modified by Stripe from time to time. Your use of payment features is subject to these Stripe terms in addition to these Terms of Service.
Legacy Payment Terms (Historical Context):
- Prior to subscription plans, Operators paid $5 to contact any applicant and a service fee equal to 50% of the first month's rent when an Applicant was accepted and occupancy began. These terms may still apply to legacy users who have not migrated to subscription plans.
Failed Payments, Grace Period, and Data Retention:
- If a recurring subscription payment is declined by your bank or card issuer, CoHomez will automatically send a payment-failure notification email to the address on file, including guidance on contacting your bank or updating your payment method.
- Following a declined transaction, your account enters a 5-day grace period during which your current plan and all features remain fully active while you resolve the payment issue.
- If the payment is not successfully resolved within the 5-day grace period, your account will automatically revert to the Free Plan, and access to paid features will be suspended.
- Data Retention: All of your data — including properties, residents, application forms, settings, and configurations — remains safely stored on the Platform during and after a payment failure or downgrade. Your data is not deleted and will be fully restored and accessible again as soon as you successfully upgrade or reactivate your subscription. However, if payment transactions fail and are not resolved to maintain an upgraded plan within 6 months, data that requires an upgraded account may be eventually deleted to free platform storage. We strongly encourage resolving payment issues promptly to avoid any loss of upgraded-plan data.
- Once your payment method is updated or your bank approves the charge, CoHomez will automatically retry the transaction and reactivate your subscription, restoring all features and your original billing dates.
- CoHomez is not liable for any loss of access to features, disruptions to operations, or inability to manage properties, residents, or applications that may occur during a payment failure or grace period.
2a. Credit System & Usage
CoHomez uses a credit-based system for platform integrations and automation. Each subscription plan includes a monthly credit allowance that is automatically added to your account at the start of each billing period:
- Free Plan: 15 monthly credits
- Landlord Plan: 150 monthly credits
- Community Pro Plan: 500 monthly credits
Credit Refresh & Rollover: Monthly credits reset at the beginning of each billing period. Unused credits do not roll over to the next period and expire at the end of the current billing cycle.
What Credits Are Used For (cost per action by plan): Credits are deducted from your balance each time you perform an automated or integration-based action:
- Sending application email invites to applicants — Free: 3 credits, Landlord: 2 credits, Community Pro: 1 credit per invite.
- AI-powered application form digitalizing (uploading a document to auto-generate a form) — Free: 5 credits, Landlord: 3 credits, Community Pro: 2 credits per digitalization.
- Automated payment reminder emails — Free: 3 credits, Landlord: 2 credits, Community Pro: 1 credit per reminder.
- Automatic late fee application when rent is overdue — Free: 2 credits, Landlord: 1 credit, Community Pro: 1 credit per application.
- Downloading PDFs (application forms, invoices, etc.) — Free: 2 credits, Landlord: 1 credit, Community Pro: 1 credit per download.
- Uploading and storing documents on a resident's profile — Free: 2 credits, Landlord: 1 credit, Community Pro: 1 credit per upload.
Credit Add-Ons (bundled with plan add-ons): Purchasing a plan add-on grants additional credits to your monthly allowance:
- Additional Home add-on: Free +25 credits ($35/mo), Landlord +40 credits ($20/mo), Community Pro +75 credits ($15/mo).
- Additional Assigned Role add-on: Free +5 credits ($20/mo), Landlord +10 credits ($10/mo), Community Pro +15 credits ($5/mo).
- Unlimited Forms & Sections add-on (Free plan only): +15 credits ($15/mo).
- Operations Suite add-on: Free +50 credits ($30/mo), Landlord +75 credits ($15/mo). Operations Suite is included at no extra charge on the Community Pro plan.
Exhausting Your Credit Balance: If your monthly credit balance reaches zero, credit-consuming actions (application email invites, AI form digitalizing, automated reminders, late fee automation, PDF downloads, and document uploads) will be temporarily unavailable until your credits refresh at the next billing period or until you purchase an add-on that grants additional credits. Core platform features that do not require credits remain available.
Credits have no cash value, are non-transferable between accounts, and are non-refundable. CoHomez reserves the right to modify credit allowances, per-action credit costs, and add-on pricing at any time with notice to active subscribers.
3. Operator Responsibilities
Operators are exclusively responsible for:
- Full compliance with all applicable local, state, and federal housing laws, including but not limited to landlord-tenant laws and regulations governing the landlord-tenant relationship in the jurisdiction(s) where they operate
- Full compliance with the Fair Housing Act and all applicable state and local fair housing laws (no discrimination — see Section 3)
- Ensuring that all screening practices, lease terms, occupancy requirements, and resident management activities comply with applicable landlord-tenant and fair housing laws
- Accuracy of listing details and representations
- Background checks and screening of Applicants
- Property compliance with safety, health, licensing, and occupancy rules
- All rents, deposits, contracts, and community rules
CoHomez does not provide legal guidance on landlord-tenant compliance and is not liable for housing conditions or legal compliance. Operators are strongly advised to consult a qualified attorney to ensure their operations comply with all applicable laws.

3a. Listing Authorization and Marketing Rights
By submitting a listing to CoHomez, Operators expressly grant CoHomez the following rights and agree to the following terms:
- Marketing Authorization: Operators authorize CoHomez to publicly market, advertise, promote, and distribute their property listings across the CoHomez platform, affiliated websites, social media channels, and third-party platforms or partnerships as CoHomez deems appropriate to maximize visibility and match opportunities.
- Listing Modifications: CoHomez reserves the right to edit, modify, reformat, or adjust any listing content, including but not limited to text, images, titles, descriptions, and pricing information, to ensure compliance with CoHomez policies, improve clarity, maintain platform standards, or optimize for search and user experience.
- Policy Alignment: All listings must align with CoHomez policies and applicable laws. CoHomez may modify or remove listings that violate these standards without prior notice.
- Future Terms Acceptance: By listing with CoHomez, Operators agree to be bound by any and all future updates, amendments, or modifications to these Terms of Service, Privacy Policy, and all CoHomez policies. Continued use of the Platform following such changes constitutes acceptance of updated terms.
Operators retain ownership of their original content but grant CoHomez a perpetual, royalty-free, worldwide license to use listing materials for the purposes stated above.
3a-1. AI-Powered "Import a Listing" Tool — User Responsibility & Content Ownership
IMPORTANT DISCLAIMER: CoHomez provides an AI-powered "Import a Listing" feature that allows Operators to paste a third-party URL (e.g., Zillow, Realtor.com, Apartments.com) to automatically copy and pre-populate listing data into their CoHomez listing. This feature is provided as a convenience tool only. By using this feature, you acknowledge and agree to the following:
- Tool Only, Not an Endorsement: The "Import a Listing" feature is merely a tool on CoHomez to copy publicly available content from a shared link into a listing draft. CoHomez does not endorse, verify, or take responsibility for the accuracy, completeness, or legality of any data copied through this feature.
- Sole Ownership & Legal Rights: By importing content from a third-party link, the user who is listing the home and adding it to their account represents and warrants that they are the rightful owner of the third-party listing and hold all legal rights to its content (including text, descriptions, photos, and any other data). The user claims full legal rights to the content they share on their CoHomez listing.
- 100% User Responsibility: The user listing the home is the sole owner of their listing on CoHomez and takes 100% responsibility for the data it displays, even when that data was gathered using the AI "Import a Listing" feature or any other CoHomez tool. The user is legally liable for using any content in their listing.
- CoHomez Takes No Responsibility: CoHomez takes no responsibility for listings created by its users. Users are the sole owners of their listings on CoHomez and are solely and exclusively liable for any content imported, displayed, or shared on their listing, including content copied from third-party sources.
- Review & Verification Strongly Advised: CoHomez strongly advises every user using the "Import a Listing" feature to review and verify all data copied into their listing before publishing. The user remains the sole owner and takes full responsibility for their listing and the data it displays, regardless of which CoHomez feature was used to gather that data.
- Indemnification for Imported Content: By using the "Import a Listing" feature, the user agrees to indemnify and hold harmless CoHomez from any claims, damages, losses, or expenses — including reasonable attorneys' fees — arising from their use of third-party content in their listing, including any claims of copyright infringement, intellectual property violation, or misrepresentation.
⚠️ STRONGLY RECOMMENDED: Before using the "Import a Listing" feature, ensure you own or have the legal rights to reuse the content from the third-party link. CoHomez is not responsible for any copyright or intellectual property claims arising from content you import into your listing. Review and verify all imported data before publishing.
3b. Application Forms, E-Signatures, Documents, and Verification Tools
IMPORTANT DISCLAIMER: CoHomez provides application form creation, management, and electronic signature workflow tools as a convenience feature to help Operators streamline their applicant screening and residency onboarding process. By using these tools, you acknowledge and agree to the following:
- No Legal Classification by CoHomez: CoHomez does not explicitly identify, classify, or certify application forms created on the Platform as legal agreements or legally binding contracts. Application forms are provided as organizational and management tools. Operators may choose to use them as legal agreements at their own discretion and sole responsibility. CoHomez does not endorse, validate, or assume any responsibility for such use.
- Operator's Choice and Full Responsibility: Operators may use CoHomez application forms however they wish, including as lease agreements, residency agreements, or other legal documents. However, Operators assume full and exclusive legal responsibility for how they use, enforce, or rely upon any application form, document, or e-signature collected through the Platform. CoHomez bears no responsibility or liability whatsoever for the legal validity, enforceability, or consequences of any such use.
- Attorney Consultation Strongly Advised: CoHomez strongly advises all Operators to have a licensed attorney review any application form they intend to use as a legal agreement before deploying it. It is the sole responsibility of each user — Operator and Applicant alike — to understand and accept the legal implications of the forms they create or complete on CoHomez.
- Electronic Signature Workflow: CoHomez provides an electronic signature workflow for user convenience. CoHomez is not a law firm, does not provide legal advice, and does not act as a public notary. E-signatures collected through the Platform are provided as a convenience feature. The legal validity of any e-signature depends on applicable law and the specific circumstances of use, which is the sole responsibility of the parties involved.
- Agreement to E-Signature Validity: By accepting these Terms of Service, both Operators and Applicants/Residents agree that: (a) electronic signatures captured within CoHomez application forms constitute valid signatures under applicable electronic signature laws; (b) application forms containing such signatures may be used as legal agreements and may be admissible in a court of law; (c) all content within a single application form constitutes one single, unified agreement between the parties; and (d) any disputes regarding the enforceability of such signatures or forms are strictly between the Operator and the Applicant/Resident — CoHomez is not a party to, and holds no liability in, any such dispute.
- No Liability for E-Signatures or Form Use: CoHomez expressly disclaims all liability for: the legal validity or enforceability of e-signatures; how Operators or Applicants use or rely on application forms; any disputes, legal proceedings, or claims arising from application forms or e-signatures; and any consequences resulting from the use of CoHomez forms as legal agreements.
- Not Legal Documents or Advice: Application forms, documents, signature fields, and any content created or uploaded through the Platform are tools only and do not constitute legal advice, legal representation, or guaranteed legally binding contracts. CoHomez is not a law firm and does not provide legal services of any kind.
- No Legal Capacity: CoHomez does not act as a lawyer, witness, notary public, legal advisor, or authorized agent for any party. We do not authenticate, verify, validate, or certify any documents, signatures, or information provided through the Platform.
- Full Operator Responsibility: Operators are solely and exclusively responsible for:
- Creating appropriate, lawful, and compliant application forms and screening criteria
- Determining what information to collect and how to use it
- Conducting thorough background checks, identity verification, and reference checks
- Making all acceptance, rejection, and residency decisions
- Ensuring all screening practices comply with Fair Housing laws, landlord-tenant laws, and applicable regulations
- Properly securing, storing, and disposing of sensitive applicant information
- Consulting with qualified legal counsel when needed
- Full Applicant Responsibility: Applicants are solely responsible for:
- Reading and understanding all forms before providing information or signatures
- Providing accurate, truthful, and complete information
- Seeking independent legal review of any documents before signing if desired
- Understanding that electronic signatures may have legal implications and agreeing that they do by completing any form requiring a signature
- No Liability or Responsibility: CoHomez expressly disclaims all liability and assumes no responsibility whatsoever for:
- The content, legality, accuracy, or enforceability of application forms created by Operators
- How Operators use, collect, store, or process application form data
- How Applicants complete, submit, or interact with application forms
- The adequacy, thoroughness, or compliance of Operator screening and verification practices
- Any acceptance, rejection, or residency decisions made by Operators
- Any disputes, claims, or legal issues arising from the use of application forms, e-signatures, or related documents
- Data security, privacy violations, or misuse of information collected through forms
- Any reliance placed on information obtained through application forms
- Platform as Tool Only: The application form feature is provided "as-is" as a management and organizational tool. CoHomez is merely a technology platform and marketplace facilitator. We are not involved in, and have no control over, the actual housing transactions, screening processes, or residency arrangements.
- No Warranties: We make no warranties, representations, or guarantees regarding the application form tools, including but not limited to their accuracy, reliability, completeness, legal compliance, or fitness for any particular purpose.
- Indemnification: Users agree to indemnify and hold harmless CoHomez from any claims, damages, losses, or expenses arising from their creation, use, or reliance on application forms, e-signatures, documents, or related screening processes.
⚠️ STRONGLY RECOMMENDED: Operators should consult with a qualified, licensed attorney to review any application forms they intend to use as legal agreements, and to ensure their screening criteria, e-signature practices, and acceptance processes comply with all applicable federal, state, and local laws, including Fair Housing regulations and landlord-tenant law. It is each user's responsibility to understand and accept how they use CoHomez application forms.
3c. Definition of "Resident" — No Tenancy Rights Conferred
The term "Resident" is used within the CoHomez platform solely as a designation for a user who has been accepted by an Operator to occupy a bed or space within a co-living home managed through the Platform. This terminology is used for organizational and management purposes only within the CoHomez platform and does not carry any legal meaning beyond that context.
- No Tenancy Rights Conferred: Being referred to as a "Resident" on the CoHomez platform does not, explicitly or implicitly, confer upon the user any rights, protections, or status under landlord-tenant law, housing law, or any other applicable local, state, or federal law. The use of the word "Resident" is not a legal classification and does not establish a landlord-tenant relationship between the user and CoHomez.
- Not a Legal Tenant: Users referred to as "Residents" within the CoHomez platform are not legally considered tenants by virtue of that designation on the Platform. Any legal relationship between a Resident and an Operator is governed solely by the agreements entered into directly between those parties and by applicable local, state, and federal law.
- Operator and User Responsibility: Operators, Residents, and Applicants are each individually and solely responsible for understanding and operating within all applicable local, state, and federal laws governing their housing arrangements, including but not limited to landlord-tenant law, occupancy regulations, fair housing requirements, and any other relevant legal frameworks. CoHomez does not provide legal guidance on these matters and assumes no responsibility for users' compliance with applicable law.
- Consult Legal Counsel: CoHomez strongly advises all Operators and users to consult a qualified, licensed attorney to understand their respective rights and obligations under applicable law before entering into any housing arrangement facilitated through the Platform.
⚠️ IMPORTANT: The Platform's use of the term "Resident" is a functional label only. It does not create, modify, or substitute any legal rights or obligations under applicable housing or tenancy law. All parties are responsible for ensuring their arrangements comply with applicable laws.
3d. Operator Responsibility for Property Operations & Management
CoHomez is a software platform only. We do not own, lease, manage, or operate any property, and we do not provide property management services. Our role is strictly limited to providing tools that assist Operators in organizing, tracking, and sharing information related to their own properties and residents.
Operators are 100% responsible for how they operate and manage their home and property. This includes, without limitation:
- The day-to-day operation, maintenance, and management of the property and all resident relationships.
- Ensuring that their use of the property complies with all applicable local, state, and federal laws and regulations.
- Reviewing and complying with local zoning laws, Homeowners Association (HOA) rules and bylaws, building codes, occupancy limits, and any other lawful regulations applicable to their property and jurisdiction.
- Obtaining any required licenses, permits, or approvals necessary to lawfully operate their property as a co-living, rental, or shared housing arrangement.
- All decisions regarding resident selection, occupancy, rent collection, community rules, and property access.
CoHomez takes no responsibility for how Operators operate or manage their home. We only provide tools for managing property information and residents. Operators assume full and exclusive responsibility for the legality, safety, and compliance of their property operations.
CoHomez strongly encourages all Operators to consult with a qualified, licensed attorney and review their local zoning laws, HOA rules, and applicable regulations before listing or operating any property on the Platform.
4. Applicant Responsibilities
Applicants are responsible for:
- Providing truthful information
- Conducting due diligence before committing to housing arrangements
- Following community rules and agreements set by Operators
Acceptance is not guaranteed.
4a. Unauthorized and Outside Transactions
To maintain a safe and transparent living environment, Residents/Guests may not participate in or solicit any unauthorized monetary transactions, loans, barter arrangements, or sale of goods or services with other Residents/Guests, staff, or representatives of the property.
If Management determines, in its reasonable discretion, that a violation of this policy has occurred, up to a $500 administrative charge may be assessed to the violating party to cover the costs associated with investigation, administration, and enforcement. Additional corrective action, including termination of residency, may be taken when appropriate.
4b. Community Features — Feeds, Resources & Events
CoHomez offers interactive social and organizational features designed to foster connection within and across co-living communities. These include: (i) the Same-Home Feed, a private group chat and social board limited to residents of a single house for sharing text posts, photos, and videos; (ii) the Resource Tab, a shared space within a house where residents and Operators can publish useful outbound links with custom titles and descriptions; and (iii) the Event Creation Engine, which allows residents and Operators to build and view calendar events across three isolated visibility tiers.
Event Visibility Tiers: Events may be scoped to one of three isolated tiers:
- (a) Internal Home Only: Visible only to residents within the same house.
- (b) Operator Portfolio-Wide: Visible to residents across all homes managed by the same Operator.
- (c) City-Wide Platform Feed: Visible to any resident across any CoHomez-registered property within the same metropolitan municipality.
User Conduct & Neighborhood Standards:
- Users must not use the Same-Home Feed or any community feature to harass, threaten, intimidate, doxx, or create a hostile living environment for other residents.
- Hate speech, discriminatory content, and targeted personal attacks are strictly prohibited on all feeds.
- Commercial spam, unauthorized advertising, solicitations, and promotional postings are strictly prohibited on Operator Portfolio-Wide and City-Wide feeds.
- Users must respect the intended scope of each feed tier and may not redistribute, screenshot, or republish content from a private feed to audiences outside its intended visibility tier.
- CoHomez may remove content and suspend access for violations of these community standards.
Resource Links & User-Generated Content (UGC) Disclaimer:
- CoHomez does not pre-screen, verify, review, or endorse any links, titles, descriptions, photos, or videos published to the Resource Tab or any community feed.
- Users access all outbound links and third-party destinations at their own risk. CoHomez is not responsible for the content, accuracy, safety, or legality of external sites or resources linked from the Resource Tab.
- Users are solely responsible for all content they post, including its accuracy, legality, and compliance with these Terms.
- Intellectual Property Indemnity: By uploading or posting photos, videos, or any media to the Platform, the posting user represents that they hold all necessary rights to that content and agrees to indemnify and hold harmless CoHomez from any claims, damages, or expenses arising from copyrighted or infringing media uploads. The posting resident is solely liable for any media they publish.
Operator Moderation Rights:
- Operators have administrative rights to delete resource links, posts, or event entries published within their direct housing network (Internal Home and Operator Portfolio-Wide scopes) without prior notice.
- Operators are responsible for reasonable moderation of their house feed to maintain a safe and respectful environment, in compliance with all applicable fair housing and anti-discrimination laws.
- CoHomez retains the right to moderate or remove any content across any tier, including City-Wide feeds, at its sole discretion.
Event Liability Waiver:
- CoHomez functions strictly as a tool provider for event creation and discovery. Events listed on the Platform are organized by residents or Operators independently.
- CoHomez holds zero liability for any injuries, property damage, theft, illegal actions, or losses occurring at or arising from any resident- or Operator-organized event.
- Users who create, attend, or participate in events do so entirely at their own risk and assume full responsibility for their safety and conduct.
- CoHomez does not verify, screen, or endorse event organizers or attendees.
5. Platform Control, Listing Removal & Enforcement
CoHomez LLC may, at its sole discretion and without notice:
- Review, approve, modify, or remove listings or content
- Suspend or terminate accounts for policy violations
- Enforce payment obligations and investigate fee circumvention
CoHomez is not liable for removal or suspension actions.
6. Safety, Verification & Assumption of Risk
CoHomez does not:
- Verify identity, criminal history, rental history, or user character
- Guarantee property legality, safety, or compatibility
Users voluntarily assume all risks of:
- In-person interactions
- Housing arrangements
- Property-related harm, theft, crime, or loss
Users release CoHomez from all claims related to user actions.
7. Limitation of Liability
To the maximum extent permitted by California law:
CoHomez and its owners, employees, and affiliates are not liable for:
- Housing disputes, eviction, loss, injuries, fraud, discrimination, property damage, unsafe environments
- Reliance on listing content or platform matching
- Application forms, documents, signatures, or any information collected, used, or processed through the application form feature
- Operator screening decisions, verification practices, background checks, or acceptance/rejection of Applicants
- Applicant-provided information, misrepresentations, or omissions in application submissions
- Data breaches, security incidents, or unauthorized access to application form data controlled by Operators
- Any damages exceeding the greater of: (1) amounts paid to CoHomez in the past 12 months or $50
8. Indemnification
Users agree to defend and indemnify CoHomez against claims arising from:
- Housing arrangements
- Violations of laws or these Terms
- Inaccurate listings or misconduct
- Creation, content, use, or reliance on application forms and related documents
- Screening practices, verification processes, and residency acceptance/rejection decisions
- Collection, use, storage, or disclosure of Applicant information obtained through application forms
- Any misrepresentation or omission of information in application submissions
9. Intellectual Property & DMCA
- Content on the Platform is protected by IP laws.
- Users grant CoHomez LLC a non-exclusive license to host, display, and distribute content as needed for Platform functionality.

10. Dispute Resolution
- Disputes must first attempt mediation.
- If unresolved → binding arbitration in California.
- Users waive class action rights.
11. Changes to Terms
CoHomez LLC may modify Terms at any time. Continued use constitutes acceptance.

- Payment information (processed by third-party providers, including Stripe for online rent payments)

- Application form data and documents submitted by Applicants to Operators, including but not limited to personal information, responses to questions, uploaded documents, and electronic signatures
2. How We Use Data
To:
- Deliver core services and enable platform communication
- Process payments and verify account activity, including facilitating online rent payments via Stripe Connect on behalf of Operators
- Improve platform features and safety
- Facilitate application form submissions and management between Operators and Applicants
- Store and transmit application data as directed by users
Note: Application form data submitted by Applicants is provided directly to the respective Operators. CoHomez acts solely as a conduit for this information and does not review, verify, or use this data for any purpose other than platform functionality.
3. Data Sharing
We may share minimum required data with:
- Operators during applicant inquiry and application form submissions
- Service vendors (e.g., payment processors, cloud storage providers)
- Legal authorities when required for safety, fraud, or compliance
- Third-party marketing platforms and partners for the purpose of promoting property listings and connecting Operators with potential Applicants
Application Form Data: Information submitted by Applicants through application forms is transmitted directly to and controlled by the respective Operators. Operators are responsible for how they collect, use, store, and protect this data. CoHomez is not responsible for Operators' data handling practices.
We do not sell personal information without consent.

5. Electronic Signatures & Form Data
CoHomez provides an electronic signature workflow for user convenience. CoHomez is not a law firm, does not provide legal advice, and does not act as a public notary. Electronic signatures and application form data processed through the Platform are handled as follows:
- E-signature data is captured and stored for the purpose of facilitating the application form workflow between Operators and Applicants.
- CoHomez does not verify, authenticate, or certify the identity of any signing party.
- Application form data and e-signatures are transmitted to and controlled by Operators; CoHomez acts solely as a technology conduit.
- Users are solely responsible for understanding the legal implications of any signatures they provide or collect through the Platform.
6. Data Retention & Breach Notices
- Data is retained as long as the account remains active and for legal compliance thereafter.
- In case of a data breach, required notifications will be issued under CA law.
7. Architectural Visibility Tiers (Community Features)
When you participate in CoHomez community features (Feeds, Resources, and Events), your data and communications travel across three geo-fenced visibility scopes. It is important to understand exactly who can see your communications:
- Same-Home Scope: Messages, posts, photos, videos, and events shared on a Same-Home Feed or scoped to Internal Home Only are visible only to residents within that single house.
- Operator Network Scope: Content scoped to Operator Portfolio-Wide is visible to residents across all homes managed by the same Operator. Your post is no longer confined to your house and may be seen by residents of other properties under that Operator.
- City-Wide Scope: Content posted to the City-Wide platform feed is visible to any resident across any CoHomez-registered property within the same metropolitan municipality. This is the broadest visibility tier.
Users should exercise discretion when posting and select the appropriate visibility tier for each post or event. CoHomez cannot guarantee that other users will not screenshot, copy, or redistribute content shared within any tier.
8. Media Processing Disclosure
When you upload photos or videos to the Platform (including feed posts and event content), our systems process and store the underlying media files on our cloud servers. This processing may include:
- Embedded media metadata, such as camera EXIF data, timestamps, geolocation tags, and device information.
- Image and video file storage, compression, and format conversion for platform display and performance optimization.
- Generation of thumbnails and display variants.
CoHomez does not actively strip EXIF data from uploaded media. Users are encouraged to review and remove sensitive metadata from media before uploading if they do not wish to share location or device information.
9. Data Lifecycle Upon Termination
When a resident leaves a house, moves out, or deletes their account, CoHomez handles data as follows to balance user privacy with community continuity:
- Profile Anonymization: The departing user's profile details (name, photo, contact information) are anonymized or unlinked from their account within community features.
- Message Retention: Historical group chat messages, posts, photos, and videos shared by the departing user are retained and remain intact to preserve conversation continuity for remaining residents. These messages may display a generic or anonymized author label (e.g., "Former Resident") after departure.
- Purpose: This retention is necessary to maintain the integrity and readability of ongoing conversations and shared community history for residents who remain in the home.
- Users who wish to remove specific content they posted prior to departure may submit a content removal request to hello@cohomez.com, subject to applicable legal obligations.
Operators must fully comply with all federal and California Fair Housing laws including nondiscrimination based on:
- Race, color, national origin
- Religion, sex, gender identity, sexual orientation
- Familial status
- Disability
- Any category protected under California law
Violation may result in immediate removal and reporting to authorities.
- All fees are non-refundable
- Any disputed transactions may be reviewed if submitted by email within 7 business days

By accessing or using the Platform, you acknowledge:

- ✔ You accept all future updates automatically
- ✔ Electronic signatures captured within CoHomez application forms can be legally valid and may be used in a court of law
- ✔ All content within a single CoHomez application form constitutes one single, unified agreement between the parties who complete and sign it
- ✔ Operators and Applicants/Residents agree that application form signatures are legally valid and that any disputes regarding application forms or e-signatures are strictly between those parties — CoHomez holds no responsibility or liability
- ✔ CoHomez bears no responsibility or liability for the use of CoHomez or any of its features, including application forms and e-signatures. All use is at the user's own risk and responsibility
- ✔ You have been advised to consult a licensed attorney regarding any application forms used as legal agreements
- ✔ When using the AI "Import a Listing" feature, you are the sole owner of your listing and claim legal rights to all content you import and share; you take 100% responsibility for your listing and the data it displays, and CoHomez takes no responsibility for listings created by its users
If you disagree with any portion of these Terms, discontinue use of the Platform.
